These terms apply to wedding photography bookings with Philip Lyons Photography.
1. Booking and payment
A booking is confirmed once the agreed booking fee has been paid and written confirmation has been issued. The remaining balance is due no later than 14 days before the wedding date unless otherwise agreed in writing.
2. Coverage and timings
Coverage is provided for the number of hours included in the chosen package. Additional coverage can be added at the current hourly rate, subject to availability. Timings should be agreed in advance, and significant delays on the wedding day may reduce the time available for planned photographs.
3. Photographer's approach and creative discretion
The photographer will use professional judgement in relation to composition, lighting, location and editing. Specific requested photographs will be accommodated where reasonably possible, but no individual image or moment can be guaranteed.
4. Creative Pick List
Creative Pick List photographs may require additional time, suitable weather, access, lighting and cooperation from the couple and venue. These images are therefore subject to the practical conditions on the day and cannot be guaranteed.
5. Image selection and editing
The final collection is selected and individually edited by the photographer. Unedited files and rejected images are not supplied. The number of delivered photographs will vary according to the wedding, the package chosen and the events of the day.
6. Delivery
Final photographs will normally be delivered through a private online gallery with high-resolution downloads. Delivery times may vary depending on workload and the time of year. Any estimated delivery date is a guide rather than a guarantee.
7. Copyright and personal use
Copyright remains with Philip Lyons Photography. The couple receives a licence to download, print and share the delivered photographs for personal, non-commercial use. Images must not be commercially licensed, sold, heavily altered or supplied to third parties for commercial use without written permission.
8. Image use by the photographer
Unless agreed otherwise in writing before the wedding, the photographer may use selected images for portfolio, website, social media, competitions, editorial features and promotional purposes. Couples who do not wish their photographs to be used in this way should advise the photographer in writing before the wedding.
9. Venues, permissions and restrictions
The couple is responsible for ensuring that photography is permitted at the venue and for informing the photographer of any restrictions imposed by the venue, registrar, celebrant or other supplier. The photographer cannot be held responsible for limitations caused by venue rules, weather, lighting, access or third-party restrictions.
10. Cancellation and postponement
The booking fee is non-refundable once the date has been reserved. If the wedding is postponed, the booking may be transferred to a new date subject to availability. If the photographer is unavailable on the new date, the booking will be treated as a cancellation.
11. Photographer illness or emergency
In the unlikely event that the photographer is unable to attend because of serious illness, injury or an emergency beyond reasonable control, reasonable efforts will be made to find a suitable replacement. If this is not possible, monies paid for photography services will be refunded and no further liability will apply.
12. Equipment failure and circumstances beyond control
Professional equipment and backup procedures are used, but no system is completely immune from technical failure. Liability for total failure to supply photographs, where caused by circumstances beyond reasonable control, will be limited to the amount paid for the photography service.
13. Guests and other photographers
The photographer cannot be responsible for missed photographs caused by guests, videographers or other photographers blocking, interrupting or delaying the agreed photography. Cooperation from the couple and key members of the wedding party is appreciated.
14. Travel and additional costs
Any travel, accommodation, parking, permit or access costs outside the agreed package will be discussed and agreed before the wedding wherever reasonably possible.
15. Data protection
Personal information supplied in connection with the booking will be used only for administering the wedding photography service, communicating with the couple and fulfilling the booking. Information will not be sold to third parties.
16. Acceptance
Payment of the booking fee confirms acceptance of these Terms & Conditions unless alternative terms have been agreed in writing.
